Marine oil spill response activities

​Notice to the public issued under section 305(1)(d) of the Maritime Transport Act 1994

To: Any member of the public

 

Incident: GOLDEN LEA

Marlborough District Council is carrying out marine oil spill response activities in response to the above incident. In order to take such action, and in the interests of public safety, the Regional On-Scene Commander considers it necessary to restrict access to [any road, public area or part of the sea] surrounding the area where the response being carried out.

Restricted Access Areas

Response activities are being carried out in areas described below. To enable response activities to be safely carried out, access to these areas is restricted as follows:

AREA A

The area shown (in red) on Map A.

Foreshore area East of Havelock Slipway towards the Sanford’s Building. The exclusion zone does not include any public road.

Access to Area A is restricted to:

Persons who are undertaking activities as part of the Marlborough District Council led response, including the salvage operation, or who are otherwise authorised by the Regional On-Scene Commander.

Offence not to comply with this Notice

Any person who, without reasonable excuse, fails to comply with this Notice commits an offence under section 316 of the Maritime Transport Act 1994, and in accordance with section 317, may be liable, on conviction, to:

•  In the case of an individual, a fine not exceeding $10,000; or

•  In any other case to a fine not exceeding $100,000.
